This is correct, higher seed rule is invoked only in the event of a dispute.
If all players accept an invitation and begin play, there has been no dispute. Elite does not care who makes the table. Some individuals seem to, and the rule exists only as a means of resolving this issue when players are behaving childishly, basically.
I myself am frequently high seed in Spades, for example, and it is rare for me to turn down an invitation. The only time I do it is when I am simultaneously making a table, and then only because I have Yahoo All Star status and thus can TITLE my tables, which makes good recruiting PR for Elite. (ELITE LEAGUE SUICIDE FINALS!, stuff like that)
